You may be tempted to send or receive drugs like marijuana or cocaine through the mail since the perceived risks involved are decreased since you can just pay using a kiosk and drop the package off without ever having to interact with a person. There is a degree of anonymity since you do not have to use a real return address.
However, when you decide to send a package through the United States Postal Service your package is subject to the Inspectors that are employed by the USPS. These inspectors primary job is to detect illicit drugs in domestic and international shipping. There are over two hundred laws in effect that cover the mailing of packages and parcels.
The dilemma that most people usually are deciding between is which provider to use to send their drugs. USPS, UPS, FED EX, and then they can decide to use an official hub or use an outpost like Post Net or Mailboxes Ect. When people think of using UPS, DHL, or FEDEX, there is a perception that it is less official and less inspectors and they have less risk of being caught. The problem with using these private couriers is that the US Supreme Court has stated there is no expectation of privacy when mailing packages with them. This means your package can be searched and opened at anytime without having a warrant issued. The USPS however, must have a warrant issued to open your package.
Another issue is that USPS is going to employ much more resources to search for and detect drugs. They use drug sniffing dogs as well as offer a reward for anyone giving information involving mailing illegal drugs through the mail. These risks are not an issue with UPS and FED EX.
If you are caught sending or receiving drugs through the mail you can be prosecuted for several crimes. At the very minimum you will be charged with drug possession.(NCGS 90-95 (a)(3)) If there is a significant amount of the drug, you can be charged with drug possession with the intent to sell and distribute, which is a felony charge.(NCGS 90-95 (a)(2)) If there is a very large amount of drugs, you will be charged with drug trafficking. There are mandatory jail time requirements with this type of charge. These are North Carolina state drug crimes. You are also subject to Federal Drug charges and Postal penalties and fines.
If you are in North Carolina and have been arrested for mailing or receiving drugs through the mail, you need to discuss your charge with an experienced Criminal Defense Attorney.
Attorney Robert Reeves and Aaron Lee are both available to discuss your charges of sending drugs through the mail.
